SURF COAST SKIP BINS

TERMS AND CONDITIONS OF HIRE

These Terms and Conditions apply to all skip bin hire services provided by Surf Coast Skip Bin Hire (“the Company”, “we”, “us”, “our”) to the customer (“Customer”, “you”).

By placing an order for a skip bin, you agree to be bound by these Terms and Conditions.

1. Hire Period
1.1 The standard hire period is 7 days unless otherwise agreed in writing.
1.2 Additional hire days may incur extra charges.
1.3 The Company reserves the right to collect the skip bin at the end of the agreed hire period without further notice.

2. Delivery and Collection
2.1 The Customer must ensure safe and clear access for delivery and collection.
2.2 The Company will not be responsible for damage to driveways, lawns, footpaths, underground services, or property where reasonable care has been taken.
2.3 If access is restricted or unsafe, additional charges may apply.
2.4 The Customer must be present if required and provide accurate delivery instructions.

3. Permits
3.1 If the skip bin is to be placed on public property (road, nature strip, footpath), the Customer is responsible for obtaining and paying for any required council permits unless otherwise agreed.
3.2 The Customer is responsible for ensuring compliance with local council regulations within the Surf Coast Shire and surrounding areas.

4. Acceptable and Prohibited Waste
4.1 Acceptable Waste
- General household waste
- Green waste
- Construction and demolition waste (non-hazardous)
- As specified at time of booking
4.2 Prohibited Waste (unless agreed in writing)
- Asbestos
- Hazardous chemicals
- Paint, oils, solvents
- Gas bottles
- Batteries
- Tyres
- Liquid waste
- Medical waste
- Explosives or flammable materials
4.3 If prohibited waste is found in the skip bin, the Customer will be liable for additional disposal fees, handling costs, and any associated penalties.

5. Weight Limits and Overfilling
5.1 Skip bins must not be filled above the rim.
5.2 Heavy materials (e.g., soil, concrete, bricks and tiles) must not exceed the agreed weight limit. Max lift 4m skip of above items 
5.3 If the bin is overloaded or unsafe to transport, the Company may:
- Refuse collection until excess waste is removed, or
- Charge additional fees.

6. Payment Terms
6.1 Payment is required no later than 7 days after invoice is issued.
6.2 Late payments may incur interest and debt recovery costs.
6.3 Prices are inclusive of GST.
6.4 Cancellation fees may apply if cancelled within [24–48 hours] of delivery.

7. Damage and Liability
7.1 The Customer is responsible for the skip bin from delivery until collection.

7.2 The Customer must not move the skip bin after placement.

7.3 The Customer is liable for:
- Theft or vandalism
- Fire damage
- Relocation by third parties
- Damage caused by misuse

7.4 The Company is not liable for indirect, incidental, or consequential loss or damage.

7.5 Liability is limited to the cost of the hire service provided.

8. Indemnity
The Customer agrees to indemnify and hold harmless Surf Coast Skip Bin Hire against any claims, losses, damages, fines, or penalties arising from:
- Improper use of the skip bin
- Illegal dumping
- Breach of these Terms and Conditions
- Failure to obtain required permits

9. Safety
9.1 The Customer must ensure the skip bin is used safely and not accessed by children.
9.2 The Customer must not light fires in the skip bin.
9.3 The Company may refuse collection if the contents are deemed unsafe.

10. Force Majeure
The Company shall not be liable for delays or failure to perform due to circumstances beyond reasonable control, including weather events, natural disasters, strikes, or road closures.

11. Privacy
Any personal information collected will be handled in accordance with applicable Australian privacy laws and used solely for the purpose of providing hire services.

12. Amendments
Surf Coast Skip Bin Hire reserves the right to amend these Terms and Conditions at any time. Updated terms will apply to future bookings.

13. Governing Law
This agreement is governed by the laws of Victoria, Australia.
